These Terms and Conditions ("Terms") govern your use of the PAS Cargo Guyana Inc. website and the freight forwarding, customs brokerage, warehousing, and related logistics services we provide. By using our website or engaging our services, you agree to these Terms.

1. Services

PAS Cargo acts as a freight forwarder and logistics provider. Unless expressly agreed in writing, we act as an agent and not as a carrier. Carriage of goods is subject to the terms and conditions of the underlying carrier (airline, shipping line, trucker, etc.) and applicable conventions (e.g., Hague-Visby Rules, Montreal Convention, or local law as applicable).

2. Quotes and Bookings

  • Quotes are estimates based on information you provide and are valid for the period stated on the quote.
  • Final charges may vary due to weight/volume verification, regulatory changes, currency fluctuation, storage, demurrage, or unforeseen charges imposed by carriers or authorities.
  • A booking is confirmed only when we issue written confirmation and any required deposit or payment terms are met.

3. Shipper Responsibilities

You are responsible for:

  • Accurate and complete description of goods, value, weight, and dimensions
  • Proper packing, labeling, and marking suitable for international transport
  • Obtaining all export/import licenses, permits, and certificates
  • Compliance with prohibited/restricted goods laws and sanctions
  • Payment of duties, taxes, and government fees unless otherwise agreed

4. Customs and Regulatory Compliance

You authorize us to act as your agent for customs clearance where agreed. You remain ultimately responsible for the accuracy of declarations and compliance with Guyana and destination country laws. We are not liable for delays or penalties caused by incorrect or incomplete information you provide.

5. Insurance

Unless we issue a separate insurance policy or endorsement, cargo is not insured by us. We strongly recommend that you arrange adequate cargo insurance for the full value of your goods. We can assist in arranging coverage upon request.

6. Liability Limits

To the fullest extent permitted by law:

  • Our liability for loss or damage to goods is limited to the lesser of the value declared by you or the limits set out in applicable carrier tariffs or conventions.
  • We are not liable for indirect, consequential, or special damages including lost profits, business interruption, or market loss.
  • Claims must be notified in writing within the time limits required by applicable carrier terms or within 14 days of delivery for visible damage and 21 days of delivery for concealed damage, whichever is stricter.

7. Payment Terms

  • Invoices are due as stated on the invoice unless credit terms are approved in writing.
  • We may exercise a lien on cargo or documents for unpaid charges.
  • Late payments may incur interest and collection costs as permitted by law.

8. Force Majeure

We are not liable for failure or delay due to events beyond our reasonable control, including weather, port congestion, strikes, pandemics, government actions, war, or equipment failure.

9. Website Use

You agree not to misuse this website, attempt unauthorized access, or use it for unlawful purposes. Content on this site is for general information and does not constitute legal or shipping advice.

10. Governing Law

These Terms are governed by the laws of Guyana. Disputes shall be subject to the exclusive jurisdiction of the courts of Guyana, unless otherwise required by mandatory international transport law.

11. Changes

We may update these Terms at any time. The updated version will be posted on this page with a revised date. Continued use of our services after changes constitutes acceptance.
